This first three columns of this table indicate what would be permitted on the 50 Government St. site according to current zoning, upcoming Provincial legislation and the “Missing Middle” housing regulations. 

The fourth column is described by the developer as “Existing Zoning Requirement” (see note 4 below). The last column lists what the developer is requesting.

Note 1; Permitted, Current Zoning

The R3-2 zone, in section 9, states the following:

“No multiple dwelling shall be erected, used or maintained on a lot having an area of less than 920m2, nor shall any multiple dwelling or other building or structure be erected, used or maintained on more than one lot.”

The 50 Government St. Site is 585m2. Therefore the applicable zoning parameters for R-2 have been listed.  However, by June, 2004 the provincial regulations would apply (see Note 2).

Part 1, Section 5,  (Page 15) requirements outline what the council is obligated to permit, but they are not necessarily the upper limit of what can be allowed. However, it is reasonable to assume that any proposal significantly exceeding these parameters may be considered unreasonable.

Section 5: “The SSMUH requirements will apply as of the date that the legislation comes into force. This means local governments must not unreasonably restrict use or density of use that
must be permitted under the SSMUH legislation”

Note Part 3, Section 3,Table 6 (Page 70), applies if the sites is not within 400m of a prescribed bus stop.  The 50 Government site is within 400m but none of the bus routes – 2,3,5,10 – individually meet the required frequency rule

“Prescribed bus stop” is determined by transit frequency and timing and is considered
to be a prescribed bus stop if it is served by at least one bus route that is scheduled to
stop at least every 15 minutes, on average, between the hours of:
(a) 7 am and 7 pm, Monday to Friday, and
(b) 10 am and 6 pm on Saturdays and Sundays.

  

 

Note 3: Missing Middle 

The data for this column is from Schedule P – Missing Middle Regulations and indicate what the City considered reasonable for a lot of this size

  

 

Note 4; Listed as “Existing Zoning Requirement”

This appears to be the parameters for the R3-2 zoneThe R3-2 zone, in section 9, states the following:

“No multiple dwelling shall be erected, used or maintained on a lot having an area of less than 920m2, nor shall any multiple dwelling or other building or structure be erected, used or maintained on more than one lot.”

The 50 Government St. Site is 585m2 and therefore the criteria listed would not apply to this site.

The figures in this column have been obtained from the “Proposed Developmnt Notice” (mailed by the City to nearby residents) or from the plans (mostly from Page 2).  The figures have not yet been verified by the City.
